Applicability
These Terms and Conditions apply to all offers, orders, and agreements between Forged by Smits and the customer, unless expressly agreed otherwise in writing.
Any deviations from these Terms and Conditions are only valid if confirmed in writing by Forged by Smits.

Products and Craftsmanship
Forged by Smits offers handcrafted jewelry and related products.
Due to the handmade nature of the products, minor variations in size, texture, or finish may occur. Such variations are inherent to the product and do not constitute a defect.

Intellectual Property
All intellectual property rights relating to the products, designs, images, texts, logos, and other materials remain the exclusive property of Forged by Smits.
Nothing in these Terms and Conditions grants the customer any license or right to use intellectual property without prior written consent.

Liability
Forged by Smits is only liable for direct damages resulting from intentional misconduct or gross negligence.
Liability is limited to the amount paid for the product in question, unless mandatory law provides otherwise.
Forged by Smits is not liable for damage resulting from improper use, wear, or external influences.

Complaints
Complaints regarding products or services must be submitted in writing via email within a reasonable time after discovery.
Forged by Smits will respond to complaints within 14 days of receipt.

Governing Law and Jurisdiction
All agreements between Forged by Smits and the customer are governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.

Amendments
Forged by Smits reserves the right to amend these Terms and Conditions at any time.
The version applicable is the version in force at the time the agreement is concluded.
